Terms of Service
These Terms of Service (the "Terms") govern your access to and use of the BeRef website and the BeRef "Proof Operating System" (together, the "Service"). The Service is provided by Ozan Ablak (Founder), established in Türkiye, operating under the brand BeRef("we", "us" or "the operator"). By accessing the site or purchasing any plan, you agree to these Terms.

1. What BeRef is
BeRef is a single-player Proof Operating System for sellers with no customer references. It is built around four modules — the Proof Profile, the Proof Vault, the Buyer Room, and the Consent Engine — and one rule: if you have no references, don't fake them — send verifiable proof. Buyers you share a Buyer Room with do not need a BeRef account, and BeRef is not a marketplace; it is a proof layer that you, the seller, control.
2. B2B / professional use only
BeRef is designed and primarily marketed for business and professional use — by founders, agencies, SaaS and micro-SaaS companies, consultants and operators acting for purposes relating to their trade, business, craft or profession. It is not aimed at consumers buying for personal use. Where, despite this, you deal with us as a consumer, your statutory consumer rights apply in full (see our Refund Policy).
Although the Service is offered for professional use, where consumer-protection law nonetheless applies to a purchase — including any distance-selling right of withdrawal under the EU Consumer Rights Directive (Directive 2011/83/EU), the UK Consumer Contracts Regulations, or Türkiye's Distance Contracts Regulation under Consumer Protection Law No. 6502 — those rights continue to apply in full, and nothing in these Terms limits, removes or shortens them. Because Paddleis our Merchant of Record, Paddle's Buyer Terms and Refund Policy also apply to your purchase, alongside our voluntary 30-day money-back guarantee (see our Refund Policy).
3. Plans & pricing
The current plans are:
- Solo Start — free, no card and no deposit; individuals only.
- Founder Pilot — $29/month or $290/year.
- Studio — $299/month (plus a one-time $299 setup fee) or $2,990/year.
- Agency — $499/month (plus a one-time $499 setup fee) or $4,990/year.
- Team — custom pricing; contact us.
Setup fees apply to monthly plans only and are waived on annual plans. The plan and the items included are confirmed at checkout; where the price on the pricing page differs from these Terms, the price shown at checkout governs your purchase.
4. Payments — Paddle as Merchant of Record
Payments for paid plans are processed by Paddle, which acts as our Merchant of Record. This means Paddle is the seller of recordfor your purchase: Paddle handles billing, issues your receipt/invoice, and collects and remits applicable taxes/VAT. Your purchase is also subject to Paddle's buyer terms presented at checkout. Refunds are governed by our Refund Policy and are carried out by Paddle to your original payment method.
Subscriptions. Paid plans auto-renew at the stated price until cancelled. We present the renewal terms clearly before purchase, record your consent at checkout, and let you cancel at any time — cancellation stops future charges and your access continues to the end of the paid period.
Refunds. As a voluntary commitment, BeRef offers a 30-day money-back guarantee: within 30 days of the order date you may request a full refund of any paid item, for any reason, provided you have not yet started using it; BeRef approves and funds the refund and instructs Paddle to process it. If we are unable to deliver the core functionality of the plan you purchased, you are entitled, as your sole and exclusive remedy for that, to a refund of the amounts you paid for the part we could not deliver, calculated on a fair pro-rata basis by reference to what was actually delivered versus what you paid for; if you disagree with our calculation you can dispute it. For digital content and digital services that you choose to start using immediately, you expressly consent to performance beginning and acknowledge that any statutory right of withdrawal may be lost once use begins (EU Consumer Rights Directive Art. 16(m) and the corresponding exemption under the Türkiye Distance Contracts Regulation), without affecting our delivery-failure refund commitment. Nothing in these Terms or our Refund Policy limits, removes or shortens any mandatory statutory right, and where a statutory right or a Paddle term is more generous, that more generous right applies.
5. Honest-proof commitment & acceptable use
The core principle of BeRef is honest, clearly-labeled proof. Every proof asset published through BeRef carries exactly one honest label from a fixed taxonomy: Live, Demo, Sample, Pilot outcome, or Founder statement. You agree not to use the Service to create, upload, publish or distribute any fake, fabricated, synthetic or misleading proof— including false reviews, testimonials, endorsements, logos, references, metrics or case studies — or to misrepresent the nature, source or label of any proof asset. This commitment reflects, among others, the prohibition on deceptive and fake endorsements under the FTC Act §5 and the FTC's 2024 rule on fake reviews and testimonials. Where the Service surfaces AI-generated or AI-assisted content, it is designed for Article 50 transparency and is EU AI Act-ready (EU AI Act Art. 50 transparency duties apply from 2 August 2026).
You also agree not to:
- break, probe, overload, disrupt or attempt to gain unauthorized access to the Service;
- scrape, crawl or harvest the Service by automated means beyond what our robots rules allow;
- upload unlawful, infringing, deceptive or harmful content; or
- use the Service in any way that violates applicable law or these Terms.
Violation of the honest-proof commitment or this acceptable-use section may result in immediate suspension or termination of your access, without refund where the breach is material.
6. User content & notice-and-action (takedown)
You retain ownership of the content you submit. When the Service hosts material you upload that relates to third parties — such as logos, company or personal names, quotes, screenshots or files — you are responsible for ensuring you have the necessary rights and consents to do so, consistent with the honest-proof commitment above and the Consent Engine.
If you are using the Service in the course of a business, trade or profession, then to the fullest extent permitted by law you will indemnify and hold the operator harmless from and against any third-party claims, demands, damages, liabilities and reasonable legal costs arising out of (a) content you upload or publish through the Service, (b) your breach of these Terms, or (c) your infringement of any third-party right — including intellectual-property, privacy or publicity rights. This indemnity does not apply where you are dealing with us as a consumer, it does not apply to the extent a claim arises from our own breach of these Terms or our unlawful conduct, and it does not affect any mandatory rights you have where consumer-protection law applies to your purchase.
We operate a notice-and-action process for allegedly illegal or infringing user content, aligned with the EU Digital Services Act (DSA Art. 14–17) and the US Digital Millennium Copyright Act (DMCA). Rights-holders and other affected parties can submit a notice via our content-reporting page or to beref@beref.tech, identifying the content, its location, and the legal basis for the request. Where a notice is valid, we may remove or disable access to the content and, where appropriate, notify the user who provided it so they can respond.
7. Intellectual property
The BeRef name, brand, content, software and design are owned by the operator or its licensors and are protected by intellectual-property law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes. You may not copy, modify, resell or create derivative works from the Service except as expressly permitted.
8. Disclaimers & limitation of liability
The Service is provided "as is" and "as available", without warranties of any kind. To the maximum extent permitted by applicable law, we disclaim all implied warranties (including merchantability, fitness for a particular purpose and non-infringement) and do not warrant that the Service will be uninterrupted, error-free or meet your requirements.
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amounts you paid for the Service in the twelve (12) months before the event giving rise to the claim, and we are not liable for indirect, incidental, special or consequential damages. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
9. Governing law
These Terms and your relationship with BeRef are governed by the laws of Türkiye (Turkey), and the courts of Türkiye have jurisdiction. This does not deprive you of any mandatory consumer-protection rights — or the right to bring proceedings in the courts — of the country where you live; where those mandatory rights apply, they prevail over this clause. Your payment is a separate contract with Paddle, our Merchant of Record, governed by Paddle's Buyer Terms (English law generally; New York law for US consumers), which likewise preserve your mandatory local consumer rights.
